A breach notice is formal and will result in a letter is being issued.
(From tenancy service) The Act sets out the rights and responsibilities of landlords and tenants. When someone doesn’t follow the rules, it’s a breach of the Act. Someone can breach the Act by:
- Not doing what they’re supposed to do.
- Doing something they’re not allowed to do.
- Adding unenforceable clauses to the tenancy agreement.
This guidance will show you how to issue a Breach Notice in Zavanti.
- Click on Tenancies under Housing to view all current Tenancies.
- Search or find the Tenancy you wish to issue a breach for.
- Click the CASES tab from the top menu.
- In the second table 'Breaches' click on + New Tenancy Breach.
- Fill in the following:
- Breach Date
- Type (select options provided from the dropdown menu)
Note: Depending on what type of breach you have chosen will determine what table and fields appear to complete
- Depending on the breach you have chosen, another type will appear to select from the drop-down options.
How to issue a breach notice (notice to Remedy)
- Click on Tenancies under Housing to view all current Tenancies.
- Search or find the Tenancy you wish to issue a breach for.
- Click the CASES tab from the top menu.
- Double click in the grey the breach you wish to open.
- On the General tab, within the breach notice.
- In the second table 'Remedy Notice' click '+New Notice to Remedy’.
- Fill in the following:
- Subject (this should be autogenerated based on the breach)
- Start Date (this autogenerates to today’s date but is editable)
- End Date (auto-changes to 14 days from the start date entered)
- Notes (internal)
- In the bottom table, Communication Template Text fill in the following:
- Not kept to your tenancy responsibilities
- Remedy the situation by doing the following
Note: These are free text fields and the information entered will automatically be added to your breach notice. Ensure these are in line with the RTA.
- On the right will be relevant question boxes related to the breach.
- Once all the information is complete, click Save.
- In the top ribbon select Word Templates.
Note: If this option is not visible, select the three dots in the top bar to find the word template option - Select ’14 Day Notice to Remedy’ word template.
- The template will automatically download.
- Click the file in your downloads to open your template.
- Read through and ensure all information is correct and accurate.
- Save the template to your computer.
- Upload the document to the Breaches folder.
- Once your breach notice has been delivered, navigate back to the General tab within the Tenancy Breach.
- On the bottom table Remedy Notices, open the line related to the notice.
- On the top right, fill in the delivery method based on the drop-down options.
- Save and Close.
